Terms of Service

By accessing or using the EducAItor application, you agree to be bound by these Terms of Service. If you do not agree to these Terms in their entirety, you must not access or use the Service.

1. License to Use

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for lawful, professional educational purposes. This license does not include any right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Service or any component thereof.

2. Account Responsibilities

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We shall not be liable for any loss or damage arising from your failure to comply with this obligation.

3. Nature of the Service — Advisory and Assistive Capacity

The Service operates exclusively in an advisory and assistive capacity. All AI-generated content — including but not limited to lesson plans, worksheets, grading assessments, and professional support responses — is provided as professional guidance to support, not supplant, the independent judgment of the User.

The User, as a licensed or practicing educator, retains full professional discretion and responsibility over all pedagogical decisions, including the adoption, modification, or rejection of any content generated by the Service. Nothing generated by the Service shall be construed as a directive, mandate, or professional recommendation binding upon the User.

Use of any AI-generated content is entirely voluntary. The Service does not compel, direct, or influence any specific course of professional action. The User's professional judgment remains paramount at all times.

Whilst the Service employs curriculum-aligned AI models designed to generate educationally appropriate and standards-compliant content, the User acknowledges that AI-generated outputs are probabilistic in nature and may, on occasion, contain errors, omissions, or content requiring professional revision. The User expressly acknowledges this inherent limitation and agrees that the Service shall bear no liability for any consequence arising from the use of AI-generated content without prior professional review.

4. Subscriptions and Billing

All paid plans include a 7-day free trial with full access to the applicable tier. Your designated payment method will be charged automatically upon the expiration of the trial period unless you cancel prior thereto. Subscription fees are billed in advance on a recurring monthly or annual basis, as selected at the time of enrollment. All fees are non-refundable except as required by applicable law. You may cancel your subscription at any time via account settings. Upon cancellation, access to paid features shall continue until the conclusion of the current billing period, after which it will terminate.

5. Prohibited Conduct

You agree not to:

  • Share, transfer, or disclose your account credentials to any third party
  • Attempt to gain unauthorized access to any other user's account or data
  • Use the Service to generate content that is harmful, discriminatory, defamatory, or in violation of applicable law
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service
  • Use the Service in any manner that could damage, disable, overburden, or impair its operation
  • Use the Service to upload, transmit, or process any content that infringes upon the intellectual property rights of any third party

6. Student Data

You represent and warrant that you shall not upload, transmit, or otherwise submit any student personally identifiable information through the Service. The Service is designed to operate without student PII by design. You are solely responsible for ensuring compliance with this obligation prior to any upload of student work.

7. Intellectual Property

All rights, title, and interest in and to the Service — including its software, design, AI models, and underlying technology — are and shall remain the exclusive property of EducAItor. Content generated by the Service using your inputs is provided to you for your professional use. You retain ownership of the inputs you provide.

8. Suspension and Termination

We reserve the right, at our sole discretion, to suspend or permanently terminate your access to the Service for any violation of these Terms, without prior notice and without liability to you. Upon termination, your license to use the Service shall immediately cease.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH CLAIM.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to you via email to the address associated with your account. Your continued use of the Service following such notification constitutes your binding acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Delaware.
